Terms and Conditions

These Terms & Conditions (“Terms”) govern your access to and use of pepperpoutbeauty.com (“Site”) and your purchase of any products or services from Pepper Pout (“we,” “our,” “us”). By using this Site or placing an order, you agree to be bound by these Terms. If you do not agree, do not use the Site. 

1. Eligibility & Account Responsibility 

You must be at least 18 years old—or the age of majority in your jurisdiction—to make a purchase. By placing an order, you confirm that you meet this requirement. If you create an account, you are responsible for maintaining its confidentiality and for all activity that occurs under your login. 

We reserve the right to suspend, refuse, or terminate any account or order at our discretion. 

2. Orders & Payment

We accept orders through the Site for personal use only. We may limit quantities or cancel orders that appear to be placed for resale or commercial use. 

You agree to provide current, complete, and accurate information for all purchases. Payment is processed securely via third-party payment providers. We are not responsible for delays or issues caused by payment authorization failures. 

3. Product Information & Availability

We aim for accuracy in all product listings, descriptions, pricing, and images. However, we do not warrant that product information is always complete, reliable, current, or error-free. 

We reserve the right to modify or discontinue products, pricing, or availability at any time without notice. 

4. Returns & Refunds

Returns are accepted on unopened, unused products with the safety seal fully intact, within 14 days of delivery. Opened or used products cannot be returned due to hygiene standards. Return instructions must be initiated by contacting hello@pepperpout.beauty. 

If your item arrives damaged or incorrect, please contact us within 7 days of delivery and we’ll resolve the issue. 

5. Intellectual Property

All content on this Site—including but not limited to product names, formulas, shade names, designs, graphics, logos, images, text, videos, software, page layout, and all other visual or functional elements—is the exclusive property of Pepper Pout or its licensors and is protected by U.S. and international intellectual property laws, including copyright, trademark, trade dress, and other proprietary rights. 

You may not copy, reproduce, publish, transmit, modify, distribute, display, create derivative works from, or otherwise exploit any part of the Site or its content, in whole or in part, for any purpose without our prior written consent. Unauthorized use is strictly prohibited and may violate copyright, trademark, and other laws. 

Pepper Pout trademarks and trade dress—including but not limited to our name, product branding, and overall aesthetic—may not be used in connection with any product or service that is not ours, in any manner that is likely to cause confusion among customers, or in any way that disparages or discredits Pepper Pout. 

We reserve all rights not expressly granted. Any misuse of our intellectual property will be enforced to the fullest extent of the law. 

6. Limited License

We grant you a limited, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes. This license does not allow:

7. Disclaimers & Limitation of Liability

All products and services are provided “as is” and “as available” without warranties of any kind, express or implied. 

To the maximum extent allowed by law, we are not liable for any indirect, incidental, special, or consequential damages, including: 

Our total liability for any claim is limited to the amount paid for the product or service in question. 

8. Dispute Resolution & Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. 

Any disputes or claims arising from your use of the Site or our products shall be resolved: 

Class action waivers apply: All disputes must be resolved individually. You may not bring claims as part of a class or collective action. 

If you wish to opt out of arbitration, email hello@pepperpout.beauty within 30 days of your first order with your full name, email, and request to opt out. 

9. Mobile Message Service Terms and Conditions

The Pepper Pout mobile message service (the “Service”) is operated by Pepper Pout (“Pepper Pout,” “we,” “our,” or “us”). Your use of the Service constitutes your agreement to these mobile messaging terms. We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Pepper Pout’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Pepper Pout through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, shipping notifications). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Pepper Pout. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt out of the Service at any time. Text the single keyword command STOP to any message you receive from us or click the unsubscribe link (where available) in any text message to cancel. You will receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Pepper Pout mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.
To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
